The family of a Black Texas sixth grader is suing her school after white students allegedly wrapped a rope around her neck and pulled her to the ground.

The $3 million lawsuit accuses Live Oak Classical School in Waco of negligence, gross negligence and intentional infliction of emotional distress.

The Daily Beast reports that the child, identified as KP, was enrolled in the majority white private school so that she could attend a school with a “better education” and a “wholesome learning environment.”

Her mother says she’s been subjected to constant bullying by her white peers who were not disciplined. The lawsuit alleges that a boy repeatedly pushed and shoved the 12-year-old.

“This is not the first time this has happened,” KP’s mom wrote in an emailed statement to the principal. “During the Tempest play rehearsal he was pushing and kicking her in the line that they were in.”

It sounds like he may have pushed on the back of her leg to make her leg buckle, which is something the kids sometimes do,” Principal Allison Buras wrote in her response. “Rarely is that done out of meanness but more out of a desire for sport.”

In another email, Buras told KP’s mother that another alleged incident was an accident and “not meant in a mean spirit.”

But the worse was yet to come. During a field trip to Germer Ranch in April, KP and several other children discovered a rope swing. The lawsuit describes it as having a long rope attached to it so the children could pull it. KP was standing to the side of the swing when three white males, including one who allegedly bullied her in the past, pulled the rope back and wrapped it around her neck. The family claims the boys then violently jerked KP to the ground, leaving abrasions on her neck.

A board member for the school described the incident as an “accident” during an interview with the Dallas Morning News. “Live Oak takes the safety of its students seriously and is saddened that one of its family suffered an unfortunate accident and injury,” Jeremy Counseller said.

When KP told adult chaperones what happened, she was given Vaseline for her neck and Motrin for the pain, the suit states. None of the adults told KP’s mother what happened.

An emergency room physician notified police on the severity of the injury, the lawsuit alleges. KP was immediately removed from the school. She is now receiving treatment and counseling for her injuries.
