The woman who lost her lawsuit agains NBA star Derrick Rose after accusing him and two others of rape has filed an appeal.
According to Sports Illustrated, the appeal was filed Thursday with the 9th U.S. Circuit Court of Appeals, and says pertinent evidence was excluded and jury instructions were tainted.
Rose and his friends were cleared last month in the case after the men testified that the accuser willingly had sex with them. The woman was seeking $21.5 million in the suit that claimed the men gang-raped her while she was incapacitated from drugs and alcohol. She contends that she never consented to sex.
Jurors found the woman’s account hard to believe and didn’t think there was enough evidence to support her claims.
In a counter suit, Rose is seeking to recoup $70,000 in court costs from the woman incurred in the civil trial which took place last month. The winner of a civil trial has the right to ask the court to require the loser of the case to pay some court cost, which Rose’s legal team requested in court documents.
