
Tracy Morgan is suing Wal-Mart over the June limo crash that killed one person and left him critically injured.
The First Sunday comedian suffered broken ribs, a broken nose and a broken leg after being hit by a Wal-Mart truck driver who swerved into another lane. His friend and fellow comedian James McNair died as a result.
The truck driver later pleaded not guilty to death by auto and assault by auto charges.
Now, Morgan, 45, is suing the retail corporation, claiming that “The defendants’ negligence was a substantial contributing factor in causing plaintiffs’ injuries,” CNN reports. The complaint was filed Thursday in the U.S. District Court in New Jersey.
In a regretful statement, Wal-Mart said. “We’re cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved.”
Morgan has since been released from a rehabilitation clinic and is recovering at home.
